ESCAPE Software End-User License Agreement (EULA)

Version 1.0 — Effective Date: 16.03.2026

PLEASE READ THIS END-USER LICENSE AGREEMENT (“AGREEMENT”) CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE ESCAPE SOFTWARE. BY DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU (“LICENSEE” OR “YOU”) AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE.

1. Definitions

“Software” means the ESCAPE software package, including all compiled binary code, Python modules, documentation, example notebooks, data files, and any updates or patches provided by the Licensor, in any form (wheel package, Docker image, or portable archive).

“Licensor” means Dr. Denis Korolkov, c/o IP-Management #9218, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany (escape.app.net@gmail.com).

“Non-Commercial Use” means use for academic research, education, or personal study that is not intended for or directed toward commercial advantage or monetary compensation. Use by a commercial entity is considered Non-Commercial only if the Software is used exclusively for independent, non-proprietary research that is not part of a product, service, or revenue-generating activity.

“AI Assistant Feature” means the optional ESCAPE Assistant functionality that uses external third-party large language model (LLM) services to generate Python code within Jupyter notebooks.

2. Grant of License

2.1. Subject to the terms of this Agreement, the Licensor grants You a non-exclusive, non-transferable, revocable, worldwide license to download, install, and use the Software solely for Non-Commercial Use.

2.2. You may install the Software on any devices under Your control, provided that all use remains Non-Commercial.

2.3. Commercial use of the Software requires a separate written license agreement with the Licensor. Contact escape.app.net@gmail.com for commercial licensing enquiries.

3. Restrictions

You shall NOT:

3.1. Use the Software for any commercial purpose without a separate commercial license from the Licensor.

3.2. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent expressly permitted by applicable law (in particular, EU Directive 2009/24/EC, Article 6, regarding decompilation for interoperability), or for the purpose of good-faith security research conducted in accordance with Section 7 of this Agreement.

3.3. Modify, adapt, translate, or create derivative works based on the Software.

3.4. Redistribute, sublicense, rent, lease, lend, sell, or otherwise transfer the Software or any rights therein to any third party.

3.5. Remove, alter, or obscure any copyright notices, trademarks, or other proprietary markings in the Software.

3.6. Use the Software in any manner that violates applicable law or regulation.

4. Intellectual Property

4.1. The Software is protected by copyright and other intellectual property laws. The Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights therein.

4.2. This Agreement does not grant You any ownership interest in the Software. You receive only the limited license rights expressly stated in Section 2.

4.3. The names “ESCAPE” and “escape-app.net” are trade names of the Licensor. You may not use them without prior written permission, except as required to describe the origin of the Software in academic citations and publications.

5. Third-Party Components

5.1. The Software includes or depends on third-party open-source components (e.g., NumPy, SciPy, Cython, PyYAML, Plotly, cereal). These components are subject to their own respective license terms, which are not modified by this Agreement.

5.2. A list of third-party components and their licenses (Software Bill of Materials) is provided alongside the Software distribution and is also available at: https://escape-app.net/sbom.html.

6. AI Assistant Feature — Transparency Notice

6.1. The Software includes an optional AI Assistant Feature that generates Python code suggestions using external third-party large language model (LLM) services.

6.2. AI-generated content. Code produced by the AI Assistant Feature is generated by an artificial intelligence system. It may contain errors, inaccuracies, or suboptimal constructions. You are solely responsible for reviewing, validating, and testing any AI-generated code before relying on it for research or other purposes.

6.3. Data transmission. The AI Assistant Feature operates via a Model Context Protocol (MCP) server. The choice of LLM provider is made entirely by You. When using the AI Assistant Feature, prompts and context may be transmitted to Your chosen LLM service provider. The Licensor does not select, control, or have access to the data sent to the LLM provider. You are responsible for reviewing the privacy policy and terms of service of Your chosen provider and for ensuring that You do not submit sensitive or confidential data.

6.4. No guarantee of correctness. The Licensor makes no representation or warranty that output produced by the AI Assistant Feature is correct, complete, or suitable for any particular purpose. Scientific results must always be independently verified.

6.5. The AI Assistant Feature is provided under the same terms as the rest of the Software. The Licensor is not the provider of the underlying LLM and assumes no liability for the behaviour, availability, or output quality of the third-party AI service.

7. Security and Vulnerability Handling

7.1. The Licensor is committed to addressing security vulnerabilities in the Software in a timely manner.

7.2. Reporting vulnerabilities. If You discover a security vulnerability in the Software, please report it to: escape.app.net@gmail.com. Please include a description of the vulnerability and steps to reproduce it.

7.3. Coordinated disclosure. The Licensor requests that vulnerability reporters follow a coordinated disclosure process, allowing at least 90 days for a fix to be developed before public disclosure.

7.4. Security updates. The Licensor will endeavour to provide security updates for the current major release of the Software. The Licensor will communicate end-of-support dates for each major version.

8. Support and Updates

8.1. Support period. The Licensor will provide security patches and critical bug fixes for each major release version of the Software for a minimum period of 1 year from the date of its initial publication, subject to available resources.

8.2. No obligation for feature updates. The Licensor is under no obligation to provide new features, enhancements, or non-security-related updates.

8.3. End of support. When a major version reaches end of support, the Licensor will communicate this via the website (https://escape-app.net) at least 6 months in advance. After end of support, no further patches will be provided for that version.

8.4. Updates and patches are subject to the terms of this Agreement unless accompanied by a revised Agreement.

9. Disclaimer of Warranty

9.1. THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF RESULTS, AND NON-INFRINGEMENT.

9.2. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS, OR THAT COMPUTATIONAL RESULTS PRODUCED BY THE SOFTWARE WILL BE CORRECT OR SUITABLE FOR ANY PARTICULAR SCIENTIFIC APPLICATION.

9.3. YOU ACKNOWLEDGE THAT THE SOFTWARE IS A SCIENTIFIC TOOL AND THAT ALL RESULTS OBTAINED USING THE SOFTWARE MUST BE INDEPENDENTLY VERIFIED BEFORE USE IN PUBLICATIONS, SAFETY-CRITICAL DECISIONS, OR OTHER CONSEQUENTIAL APPLICATIONS.

9.4. Nothing in this Section limits any rights You may have under mandatory provisions of applicable law, including but not limited to EU Directive 2024/2853 (Product Liability Directive) and Regulation (EU) 2024/2847 (Cyber Resilience Act), to the extent they apply.

10. Limitation of Liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF RESEARCH RESULTS, BUSINESS INTERRUPTION, OR DAMAGE TO REPUTATION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE SOFTWARE SHALL NOT EXCEED THE AMOUNT, IF ANY, PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR, IF NO AMOUNT WAS PAID, EUR 100), TO THE EXTENT SUCH LIMITATION IS PERMITTED BY APPLICABLE MANDATORY LAW.

10.3. The limitations in this Section do not apply to liability arising from (a) wilful misconduct or gross negligence by the Licensor, (b) death or personal injury caused by the Licensor’s negligence, or (c) any other liability that cannot be excluded or limited under applicable mandatory law.

11. Data Protection

11.1. The Software itself does not, as of the date of this Agreement, collect, transmit, or process personal data of its users, except when the optional AI Assistant Feature is used (see Section 6).

11.2. The Licensor’s website (https://escape-app.net) may collect personal data as described in the Privacy Policy available at: https://escape-app.net/legal.html

11.3. Processing of personal data by the Licensor is governed by EU Regulation 2016/679 (General Data Protection Regulation) and applicable German data protection law.

12. Term and Termination

12.1. This Agreement is effective from the date You first download, install, or use the Software and remains in effect until terminated.

12.2. You may terminate this Agreement at any time by uninstalling the Software and ceasing all use and deleting copies within Your reasonable control.

12.3. The Licensor may terminate this Agreement immediately upon written notice if You breach any term of this Agreement.

12.4. Upon termination, all license rights granted under this Agreement cease immediately. You must uninstall the Software and delete all copies within Your reasonable control.

12.5. Sections 4, 9, 10, 11, 13, and 14 survive termination of this Agreement.

13. Governing Law and Dispute Resolution

13.1. This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

13.2. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Hamburg, Germany, except where mandatory consumer protection law provides for a different jurisdiction.

13.3. If You are a consumer within the meaning of EU law, You retain all mandatory rights afforded to You under the laws of Your country of residence, and nothing in this Agreement restricts those rights.

14. General Provisions

14.1. Entire Agreement. This Agreement constitutes the entire agreement between You and the Licensor regarding the Software and supersedes all prior agreements, understandings, and representations, including the previously applicable CC BY-NC-ND 4.0 license terms.

14.2. Amendments. The Licensor may update this Agreement from time to time. Updated versions will be published at https://escape-app.net and will apply to downloads and installations made after the update date. For existing users, the updated terms take effect 30 days after publication. If You do not agree to the updated terms, You must cease use of the Software before the 30-day period expires.

14.3. Severability. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the original intent.

14.4. No Waiver. Failure by the Licensor to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.

14.5. Assignment. You may not assign or transfer this Agreement or any rights hereunder without the Licensor’s prior written consent. The Licensor may assign this Agreement freely.
